Federal Tribunal raises rules for daylight time for truck drivers
The Federal Court deals with a clash against the USA-Trucking-enterprises in July by the strong determination of rules on working time, strongly criticized by supporters of security.
The decision is the latest chapter in a long struggle between the defence groups like Public Citizen and Transportation Department’s Federal Motor Carrier Safety Administration, who fought, an extension of truck drivers rule “hours of service since 2003.
Judge Merrick B. Garland, in writing for a three-judge panel of the U.S. Court of Appeals for the DC Circuit invalidated a law of the Federal Agency for Security in August 2005 that allows truck drivers to drive 11 hours in a line rather than the previous limit of 10
The judge asked a rule that would have actually increased the time weekly hours for drivers of at least 25 percent, said the critics.
The agency failed to follow proper procedure for issuing two measures that the Tribunal said, as public opinion about the 11 hours do not exceed. The provisions were part of greater regulation, could not be held.
The FMSCA said he was still analyzing the decision and considering its next steps.

The two measures is different to stay until the September 14, if the court decision takes effect, the FMCSA said.
“The good news is that the decision gaps that the Tribunal has found that procedural issues were in nature and can be corrected by the Agency,” said ATA.
“We are pleased with the decision,” Bonnie Robin Vergeer, a senior lawyer for Public Citizen Litigation Center, said. “Long-truck drivers to drive many hours, and a rule which allows them to take more hours is dangerous to the public and the drivers themselves. ”
Robin Vergeer, the Court annulled the decision to express “serious doubts” on many aspects of the rule and argued that the Tribunal would have little chance to keep motivated.
Under the same decision, the Court rejected a challenge by the owner of the operator Indepen-dent Drivers Association in regard to those parts of the rule that a reduction in the number of pre-mandatory 14 hours to 15
The first driver renewable FMCSA successive 11 hours per week increases and limits of 2003, as a rule. Previously, the limit in successive hours, amounted to 10 over 60 years.
But this rule has been impressed by the same meeting, in 2004, after a challenge by Public Citizen. The FMCSA rule in August 2005 was basically the same as its predecessor, with some changes in order to mollify the Tribunal.
